Every single step you take as an employer to minimize liability of your employees’ use of Social Media in the workplace counts! As an employer you have a business interest in protecting confidential information, brand/image and employee morale and productivity, as well as insulating yourself from legal liability resulting from your employees’ social media activities. Key in meeting these goals is not to skip a single step in the process of creating, implementing and enforcing a comprehensive social media policy in your organization.
In this presentation we will review recent decisions by the National Labor Relations Board regarding its stance on employers’ social media policies, the appropriate prohibitions that a social media policy can include, as well as the scope of a policy and how to implement it. This presentation will also discuss the use of Social Media as evidence in Employment Litigation.

Nicholas Fortuna is founder and managing partner of the law firm Allyn & Fortuna LLP. He specializes in complex employment, commercial and corporate litigation, and his diverse practice encompasses a broad range of clients, including Fortune 500 companies, nationwide retailers, biotech firms, banks, non-profits, etc. With more than 25 years of practice, Mr. Fortuna has successfully advised employers on a wide range of employment law issues and has litigated cases before juries and judges in federal and state courts, argued cases before federal and state appellate courts, and handled matters before administrative tribunals and federal, state and municipal regulatory agencies. He is highly respected in the legal community and he writes extensively on various topics regarding employment law developments and emerging legal issues on the firm’s blog at www.allynfortuna.com as well as book reviews and articles.
Paula Lopez is a partner of the law firm Allyn & Fortuna LLP. She specializes in employment law, complex civil litigation matters and administrative regulatory law. Ms. Lopez has represented a broad range of organizations, and she litigates and advises clients on a wide range of employment issues with the intent to prevent claims by employees. But when the inevitable claim is brought to court or before a state, Ms. Lopez has the experience, skills and judgment needed to successfully defend such claims on behalf of the firm’s clients.
